法官本來就不是一個可以動腦子思考的職業，因為法官的執掌就是要忠實的照本宣科照章辦事，在這些限制下法官越是動腦就越有偏袒之嫌，你希望法官多動腦在他的工作上到底居心何在？是不是只要法官不按照你的想法做就是沒腦子？那你怎麼不檢討檢討是不是你沒腦子。

每一位法官不論學識與智慧也很卓越,但人住住受制於學識思維,在審案中先入為主,引至未能持平客觀分析-呢個情況在世界每一個地方也有出現,但绝無謹有,以香港為例,每年法院大概處理50000宗案件,但能成功推返原審的案件不多,用古語表達10隻手指數得曬........總括：法官聰明才智,學識品行,思考分析,为人處事等等，也並非每一個人也能勝任..... （以上純粹個人觀點,如有錯誤或不同見解請包涵thx??
